1. General

The company Balanso GmbH, Wolfratshauser Strasse 9, D-82049 Pullach im Isartal (hereinafter “Balanso”), operates an online shop at www.balanso.de, through which products and services for a more basic life are offered for sale.

The below www.basen.app The goods offered are shown on the website in the form of digital photographs of the real goods. Slight deviations between presentation and reality do not constitute a defect in the goods ordered.

These general terms and conditions regulate all legal relationships between Balanso and the customer (consumer within the meaning of § 13 BGB or entrepreneur within the meaning of § 14 BGB), with regard to the goods or services shown in the online shop, unless individual provisions expressly apply only to consumers or only to entrepreneurs .

The general terms and conditions apply in the version valid at the time the contract is concluded. Any terms and conditions of the customer do not apply unless Balanso has expressly agreed to them in writing beforehand.

2. Formation of a contract

Information on the website represents non-binding offers for placing an order. After the customer receives the binding order (= click the button "order with payment"), the purchase contract only comes through the written contract confirmation (also fax or e-mail) by Balanso, otherwise by sending the goods. If the purchase contract is not concluded at the latest 2 weeks after receipt of the order, the offer is considered rejected. The automatic confirmation of the order receipt does not constitute acceptance of the contract offer.
The order text and the data of the order are not saved at Balanso in a form that is subsequently accessible to the customer and can no longer be called up after the order process has been completed. The customer should therefore copy, print out or save his order data in any other way.

The prices listed for the goods and services in the online shop at the time of the order apply. All prices include the applicable statutory sales tax of the Federal Republic of Germany. Customers who are not resident in Germany have to explicitly contact Balanso for any desired separate invoicing.
Shipping costs are calculated separately.

Payment of the shipping costs is made either for the shipping costs via PayPal or credit card or bank transfer. All payments and credit notes for shipping costs are processed in euros.

The payment of the goods is made by YEM. All payments and credit notes for goods are processed in YEM.

When using the PayPal payment method, the contractual relationship between PayPal and the customer is based exclusively on PayPal's terms of use. For security reasons, payment via PayPal is made directly when ordering, since the customer enters his data himself and directly on the provider's secure payment server.

If the customer wants a payment method that is not listed here, please contact Balanso.

5. Shipping and delivery conditions

Unless otherwise agreed, delivery is ex warehouse to the delivery address specified by the customer.

Balanso reserves the right to make partial deliveries insofar as this is reasonable for the customer. Unless otherwise expressly agreed, Balanso will bear increased shipping costs due to partial deliveries.

When delivering abroad, customs and customs processing costs may arise, over which Balanso has no influence. These fees are borne by the customer. Please consult the responsible customs authority before ordering and inquire about the fees. Balanso itself does not charge any other fees apart from the delivery costs for the respective country.

The flat rate for shipping within Germany is € 9.95 for consumers. For all other countries in the EU, including Switzerland, the flat shipping fee for consumers is € 13.95. The shipping costs for countries not specified here can be found directly at Balanso by requesting service@balanso.de

If the customer requests a special form of dispatch (e.g. express delivery), he bears the additional costs. The customer must inquire at Balanso beforehand about the costs.

Should circumstances arise after the conclusion of the contract due to force majeure (e.g. strike, official order, operational impediments) which Balanso is not responsible for and which makes delivery by Balanso impossible, Balanso shall be released from the obligation to deliver. In return, the customer is released from his payment obligation. If the delivery is delayed due to the above-mentioned cases of force majeure through no fault of your own, Balanso's usual delivery time will be extended accordingly.

If delivery is made difficult or impossible due to events for which it is not responsible (e.g. strikes, official orders, etc.), then Balanso is not responsible for the delays that occur as a result.

6. Cancellation policy
Right of withdrawal
If the customer is a consumer, he has the right to cancel the contract in text form (e.g. letter, fax, e-mail) within 14 days without giving any reason. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither their commercial nor their independent professional activity.

The cancellation period is 14 days from the day on which the customer or a third party named by him, who is not the carrier, took possession of the goods.

In order to exercise the right of withdrawal, the customer must Balanso (Balanso GmbH, Wolfratshauser Strasse 9, D-82049 Pullach im Isartal, service@balanso.de) by means of a clear statement (e.g. a letter sent by post, a fax or an email ) about his decision to cancel this contract. He can use the model withdrawal form below, but this is not mandatory.

To safeguard the cancellation period, it is sufficient that the customer sends the notice of the exercise of the right of withdrawal before the expiry of the withdrawal period.

If the customer wishes to cancel the contract, he can download the form, fill it in and send it to the Balanso address mentioned above.

· Consequences of cancellation

In the event of an effective cancellation, the services received on both sides must be returned.

Balanso has the customer all payments without delay, including delivery costs (with the exception of the additional costs resulting from the customer choosing a different type of delivery than the cheapest standard delivery offered by Balanso) without delay and to be repaid at the latest within 14 days from the date on which the notification of cancellation of this contract was received. For this repayment, Balanso uses the same means of payment that the customer used in the original transaction, unless expressly agreed otherwise with the customer; under no circumstances will the customer be charged for this repayment. Balanso can refuse the repayment until they receive the goods back or until the customer has provided proof that he has returned the goods, whichever is the earlier.

The customer must return or hand over the goods to Balanso immediately and in any event within 14 days from the day on which he informed Balanso of the cancellation of this contract. The deadline is met if he sends the goods before the 14 day period has expired. The customer has the choice either to return the goods to Balanso freely or to have the goods picked up at his home. If the customer wishes the goods to be picked up, please contact Balanso at service@balanso.de.

The customer bears the cost of returning the goods under the following conditions:

· The price of the goods that he sends back does not exceed a total of € 40.-;
· The price of the goods that he sends back exceeds a total of € 40.- but he has not yet made any payment or partial payment at the time of cancellation;

The customer is not obliged to bear the cost if the delivered goods do not correspond to the goods ordered by him.

If the customer cannot return the received service to Balanso in whole or in part or only in a deteriorated condition, he may have to compensate Balanso in this respect. He only has to pay for any loss in value of the goods if this loss in value is due to handling the goods, which goes beyond checking the property, quality or functionality. Checking the property, quality or functionality means testing and trying out the respective goods, as is possible and customary in a shop.
